Time Is Running Out: Open Letter to All German Parliamentarians on the WHO Pandemic Treaty

Total control, isolation, lockdowns, vaccination campaigns: Just some of the dictatorial measures for global health control envisaged by the WHO pandemic treaty

The planned WHO pandemic treaty poses one of the greatest threats to the sovereignty of all countries, to the democratic self-determination of citizens and to the unwavering guarantee of fundamental rights and freedoms of all people. Despite this, the dangers and risks of this global health policy empowerment law have not even been remotely understood - unfortunately not even by many German politicians and members of parliament, who are responsible for ratifying this disastrous document.

I am therefore addressing the following open letter to all members of the German Bundestag, the German Bundesrat and the state parliaments in order to emphasise once again the implications of the decision on the WHO pandemic treaty and the WHO's International Health Regulations and to call for a lively and open parliamentary debate to ensure that this fatal agreement is not waved through without a second thought.

Ladies and gentlemen,

27 January 2024 was the deadline by which the WHO should have submitted the consultative drafts of the Pandemic Agreement (PA) to the member states in accordance with Articles 19 and 20 and the International Health Regulations (IHR) in accordance with Articles 21 and 22 in order to meet the deadline specified in the WHO constitution. This constitution is the basic legal order of this UN sub-organisation. The legality of decisions taken by its bodies therefore depends on whether they are based on the Statute and comply with the Statute. No organ can make a legally compliant decision outside of the competences granted to it. A violation of the Statutes would mean that the two legal instruments could not be negotiated at the 77th World Health Assembly from 27 May to 1 June 2024.

In their current form, the two legal instruments would give the WHO the power to order any emergency measure and censor scientific debate and free discourse in the media (allegedly to combat the "infodemic") in the event of a public health emergency of international or regional importance that it alone could declare, even in the event of only potential threats. It will issue binding orders, rather than just recommendations as before, and implement appropriate monitoring and control measures. It will be able to control the production and allocation of all health products, order lockdowns, daycare centres, schools and universities to close, impose travel restrictions, demand compulsory medical examinations and vaccinations and global health certificates, and demand substantial financial contributions from individual countries.

The WHO could therefore switch our democracy OFF and ON by declaring a public health emergency of international or regional concern (PHEIC or PHERC). The switch is in the hands of a single, non-transparently elected and criminally unaccountable person, the WHO Director-General Dr Tedros Adhanom Ghebreyesus. He was a member of the terrorist People's Liberation Front of Tigray from the beginning, Ethiopian Minister of Health (2005-2012) and Foreign Minister (2012-2016) of this murderous regime before becoming Director-General of WHO in 2017.

The WHO is not democratically legitimised, all of its employees enjoy criminal immunity under Article 13 of the WHO constitution, no legal action can be taken against WHO decisions and 80% of its budget is funded by private sponsors (above all: the Bill and Melinda Gates Foundation) and its strategy is determined by them (World Economic Forum, Rockefeller Foundation, etc.).

In the draft of the IHR-2024, the previous principles of action (respect for dignity and human rights and freedoms) were completely replaced by the new principles of action (equity, diversity and inclusion); in the latest version of the pandemic treaty, dignity was only reinstated as a guiding principle after strong international opposition, but was clearly relativised. The deliberations on the two "legal institutions" are taking place in secret. In their current form, they contradict all the principles of our constitution, the free and democratic basic order as well as the principles of the rule of law, democracy and federalism.

We only have four months left to put an end to the haunting of a one-world health regime, to reject this international empowerment law and to prevent our national declaration of submission, as many other states have done in the meantime. If the IHR-2024 are adopted by a simple majority at the 77th General Assembly of the World Health Organisation and are not rejected by the German government, they will become binding instruments under international law from May 2025. If the pandemic treaty is adopted by a 2/3 majority, it must be submitted to the Bundestag and Bundesrat for ratification.

In particular, I call on you to demand parliamentary discussion of the IHR-2024 in the parliamentary groups, in the Health and Legal Affairs Committee and with the government.

I call on you to ask the Ministry of Health to commit to the current status of the negotiations between the European Commission and to revoke the delegation of tasks to the Commission and to take over the conduct of negotiations again immediately.

I call on you to have the IHR-2024 and the pandemic treaty translated by the scientific services and analysed in detail for its legal consequences for all departments. This is no longer a question of health, it is a question of our existence.

I call on you not to approve the IHR 2024 draft now and to hold a democratic, transparent, public debate on its content.

I call on you to end Germany's disproportionate direct and indirect payments to the WHO and to discuss the option of Germany withdrawing from the WHO.

WHO-Pandemievertrag und WHO-Internationale Gesundheitsvorschriften

Sehr geehrte Damen und Herren,

der 27. Januar 2024 war der Stichtag, an dem die WHO den Mitgliedsstaaten gem. Art. 19 und 20 die Beratungsentwürfe des Pandemievertrages (Pandemic Agreement - PA) und gem. Art. 21 und 22 der Internationalen Gesundheitsvorschriften (International Health Regulations – IHR) hätte vorlegen müssen, um die in der WHO-Satzung vorgegeben Frist einzuhalten. Diese Satzung ist die rechtliche Grundordnung dieser UN-Unterorganisation. Die Rechtmäßigkeit von Entscheidungen, die ihre Organe treffen, hängt somit davon ab, ob sie ihre Grundlage in der Satzung haben. Außerhalb der eingeräumten Kompetenzen kann kein Organ eine rechtskonforme Entscheidung treffen. Eine Verletzung der Satzung hätte zur Folge, dass die beiden Rechtsinstrumente in der 77. Weltgesundheits-Generalversammlung vom 27. Mai bis 1. Juni 2024 nicht verhandelt werden dürften.

Die beiden Rechtsinstitute würden -in ihrer jetzigen Fassung- der WHO bei einem von ihr alleine und schon bei dann nur potenziellen Gefahren ausrufbarem öffentlichem Gesundheitsnotstand von internationaler oder regionaler Bedeutung die Befugnis geben, jedwede Notfall-Maßnahme noch leichter anzuordnen, wissenschaftliche Debatten und den freien Diskurs in den Medien zu zensieren (angeblich um die „Infodemie“ zu bekämpfen); sie wird bindende Anordnungen erteilen (statt wie bisher nur Empfehlungen auszusprechen) und entsprechende Überwachungs- und Kontrollmaßnahmen durchführen, sie wird die Produktion und Zuteilung aller Gesundheitsprodukte kontrollieren, Abriegelungen, Kita-/ Kiga-/ Schul- und Universitätsschließungen anordnen, Reisebeschränkungen aussprechen, medizinische Zwangsuntersuchungen und -impfungen, globale Gesundheitsbescheinigungen verlangen können, sowie erheblicher finanzielle Beiträge einzelner Staaten einfordern dürfen.

Die WHO könnte also durch die Ausrufung eines Gesundheitsnotstandes von internationaler oder regionaler Bedeutung (engl.: PHEIC oder PHERC) unsere Demokratie AUS- und EIN-schalten. Der Schalter liegt in der Hand einer einzelnen, nicht transparent gewählten und strafrechtlich nicht verantwortlichen Person, des WHO-Generaldirektors Dr. Tedros Adhanom Ghebreyesus. Er war von Anfang an Mitglied der terroristischen Volksbefreiungsfront von Tigray, äthiopischer Gesundheitsminister (2005-2012) und Außenminister (2012-2016) dieses mörderischen Regimes, ehe er 2017 Generaldirektor der WHO wurde.

Die WHO ist nicht demokratisch legitimiert, alle seine Mitarbeiter genießen gem. Art. 13 der WHO-Satzung strafrechtliche Immunität, gegen Entscheidungen der WHO kann richterlich nicht vorgegangen werden und ihr Haushalt wird zu 80% von privaten Sponsoren getragen (allen voran: der Bill-und-Melinda-Gates-Stiftung), bzw. ihre Strategie von diesen bestimmt (World Economic Forum, Rockefeller-Stiftung u.a.).

Im Entwurf der IHR-2024 wurden die bisherigen Handlungsprinzipien (Beachtung der Würde sowie der Menschen- und Freiheitsrechte) durch die neue Handlungsprinzipen (Equity, Diversity und Inclusion) gänzlich ersetzt; im Pandemievertrag wurde die Würde in der jüngsten Version als Handlungsmaxime erst nach internationalem Widerspruch wieder eingesetzt, jedoch stark relativiert. Die Beratungen über die beiden „Rechtsinstitute“ finden im Geheimen statt. Sie widersprechen in der derzeitigen Form allen Prinzipien unserer Verfassung, der freiheitlich-demokratischen Grundordnung ebenso, sowie dem Rechtsstaats-, dem Demokratie- und dem Föderalismusprinzip.

Wir haben nur noch vier Monate Zeit, um dem Spuk eines One-World-Gesundheitsregimes zu beenden, dieses internationale Ermächtigungsgesetz abzulehnen und unsere nationale Unterwerfungserklärung zu verhindern, wie viele andere Staaten auch. Werden die IHR-2024 bei der 77. Generalversammlung der Weltgesundheitsorganisation mit einfacher Mehrheit beschlossen und von der deutschen Regierung nicht widersprochen, werden sie ab Mai 2025 völkerrechtlich verbindliche Instrumente. Wird der Pandemievertrag mit 2/3-Mehrheit beschlossen, muss er Bundestag und Bundesrat zur Ratifizierung vorgelegt werden.

Ich rufe Sie insbesondere auf, die parlamentarische Beratung der IHR-2024 in den Fraktionen, im Gesundheits- und Rechtsausschuss und mit der Regierung einzufordern.

Ich rufe Sie auf, das Gesundheitsministerium aufzufordern, den aktuellen Stand der Verhandlungen zwischen der Europäischen Kommission und der WHO zu veröffentlichen.

Ich rufe Sie dazu auf, die Bundesregierung zu verpflichten, die Aufgabenübertragung an die Kommission zu widerrufen und die Verhandlungsführung unverzüglich wieder selbst zu übernehmen.

Ich rufe Sie dazu auf, die IHR-2024 und den Pandemievertrag von den Wissenschaftlichen Diensten übersetzen und auf seine rechtlichen Folgen für alle Ressorts genau analysieren zu lassen.

Ich rufe Sie dazu auf, dem IHR-2024-Entwurf schon jetzt nicht zuzustimmen und eine demokratische, transparente, öffentliche Diskussion über seine Inhalte zu führen.

Ich rufe Sie dazu auf, die überproportionalen direkten und indirekten Zahlungen Deutschlands an die WHO zu beenden und die Option des Austritts Deutschlands aus der WHO zu diskutieren.
